Terms of Service

Please read these Terms of Service ("Terms") carefully before using Otter Zero ("Service", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Otter Zero is an AI-powered marketing automation platform that enables users to deploy autonomous agents that engage with social media content, generate affiliate marketing replies, and track click attribution and earnings. The Service operates on a subscription basis with tiered plans (Free, Basic, Pro).

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements. The Service is intended for business and professional use only.

3. Accounts and Access

Access to the Service is currently by invitation only. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at legal@otterzero.ai.

4. Subscriptions and Billing

Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Creem.io. All fees are in USD and exclusive of applicable taxes. You authorize us to charge the payment method on file for recurring subscription fees. Prices are subject to change with 30 days' notice.

  • Free Plan: No charge. Subject to usage limits as specified on the pricing page.
  • Basic Plan: $29/month or $290/year. Subject to plan-specific limits.
  • Pro Plan: $79/month or $790/year. Unlimited usage within fair use policy.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party platform terms of service (including X/Twitter, LinkedIn, or any other social media platform).
  • Send spam, unsolicited messages, or engage in deceptive affiliate practices.
  • Circumvent or attempt to circumvent platform-level rate limits or anti-automation measures.
  • Use the Service to harass, abuse, or harm individuals.
  • Resell or sublicense access to the Service without written permission.

We reserve the right to suspend or terminate accounts that violate these policies without prior notice. You are solely responsible for ensuring your use of automated agents complies with the terms of any social media platforms where agents operate.

6. AI-Generated Content

The Service uses large language models (LLMs) to generate content, including social media replies and affiliate recommendations. You acknowledge that:

  • AI-generated content may occasionally be inaccurate, incomplete, or inappropriate.
  • You are responsible for reviewing and approving content before publication where the review feature is enabled.
  • We make no warranties regarding the accuracy, quality, or fitness of AI-generated content for any particular purpose.
  • You retain all responsibility for content published through the Service on your behalf.

7. Intellectual Property

The Service and its underlying technology, including software, algorithms, and interfaces, are owned by Otter Zero and protected by intellectual property laws. You retain ownership of content you create or provide to the Service. You grant us a limited license to process your content solely for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Otter Zero and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that agents will achieve any particular marketing or earnings outcomes. Affiliate earnings depend on many factors outside our control.

10. Termination

You may cancel your subscription at any time from the billing settings page. Upon cancellation, your paid plan remains active until the end of the current billing period, after which you will be downgraded to the Free plan. We may terminate or suspend your account for violation of these Terms at our sole discretion.

11. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which Otter Zero operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
